1. Introduction & Acceptance of Terms
Welcome to RealEstateSmartly Academy (“RealEstateSmartly,” “RES,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website (realestatesmartly.com), online courses, AI-powered Smart Property Assistant, educational content, checklists, document vault, and all related products and services (collectively, the “Services”).
By accessing or using any part of our Services, you (“User,” “Learner,” “you”) acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and Refund Policy. These Terms constitute a legally binding agreement. If you do not agree with any part of these Terms, you must not access or use our Services.
Key Definitions: “AI Smart Assistant” refers to our automated document summarization and property verification tools. “Document Vault” refers to secure cloud storage for property documents. “Courses” means all video-based educational content, toolkits, and checklists. “Services” excludes legal, financial, or RERA consulting — we are an education platform, not a law firm.
2. Professional Disclaimer & No-Guarantee
Educational Purposes Only: All Services, including video courses, printable field checklists, and AI-driven document summaries, are provided for educational and informational purposes only. We do not provide legal, financial, or RERA consulting services.
No Professional Relationship: Use of our Services does not create an attorney-client or financial advisor relationship. Independent Verification: Property transactions involve significant financial risk. You are solely responsible for conducting your own due diligence and consulting with a registered advocate, CA, or professional before executing any legal documents (Sale Deed, Mother Deed, EC, etc.).
No Results Guarantee: We do not guarantee employment, specific ROI, or successful property acquisition. Any savings mentioned (e.g., ₹10L+ saved by students) are based on past experiences and are not a guarantee of future outcomes.
Builder/Broker Independence: RealEstateSmartly Academy does not accept commissions, incentives, kickbacks, or referrals from builders, brokers, or real estate agents. All educational content and AI recommendations are unbiased and buyer-focused. Any sponsored content will be explicitly disclosed.
3. User Accounts & Eligibility
To register, you must be 18 years of age or older or have explicit parental/guardian consent. You guarantee that all information provided (Name, Email, Phone, User ID) is accurate, complete, and current.
Confidentiality: You are responsible for maintaining the secrecy of your password. You accept responsibility for all activities under your account. No Account Sharing: Sharing login details or allowing unauthorized access to our proprietary IP is strictly prohibited and will result in immediate termination without refund.
NRI Compliance Disclaimer: Non-Resident Indians using our educational content are solely responsible for complying with FEMA, RBI, and income tax regulations. Our courses provide general guidance only and do not constitute certified legal advice for cross-border transactions.
4. Courses, AI Tools & Intellectual Property
Limited License: Upon full payment, we grant you a limited, non-exclusive, non-transferable license to access course content for personal, non-commercial use only.
Time-Bound Access: Standard enrollment provides access for 12 months to the current version of the course. Access is not “lifetime” unless explicitly stated.
AI Smart Assistant: Our AI tools summarize documents (Mother Deed, EC, RERA). These are educational starting points and may contain inaccuracies. You must independently verify all AI insights with government records.
AI Tool Fair Use Policy: The AI Smart Property Assistant is provided with fair usage limits of 500 document uploads or 1,000 queries per month per user. Excessive usage may result in throttling or additional charges. AI outputs are not legal advice and must be independently verified.
Data Retention & Deletion (DPDP Act Compliance): Documents uploaded to the Document Vault or AI Assistant are retained for 180 days after account termination, after which they are permanently deleted. You may request earlier deletion by emailing legal@realestatesmartly.com. We do not sell your personal data to third parties.
Proprietary Rights: All content — videos, field checklists, PDF toolkits, algorithms — is the exclusive property of RealEstateSmartly Academy. You may not reproduce, redistribute, resell, or create derivative works.
5. Prohibited Activities
- Use automated means (robots, scrapers, or AI bots) to access or harvest data from our Services.
- Introduce viruses, Trojan horses, worms, or logic bombs.
- Record, screenshot, or download course videos and proprietary checklists for redistribution.
- Engage in harassment, hate speech, or spamming instructors and fellow students.
- Misuse lab equipment, datasets, or attempt unauthorized access to our servers/databases.
6. Payments, Fees & Taxes
Pricing: We reserve the right to modify prices (including the ₹99 launch offer) at any time. Secure Processing: Payments are processed via secure third-party gateways (UPI, Cards, Net Banking). We do not store your credit card details. Taxes: Users are responsible for all applicable taxes (GST) arising from use of Services. Access is granted only upon successful payment confirmation.
7. Cancellation & Refund Policy
Due to the digital nature of our courses and immediate access to intellectual property, refunds are available only within 7 days of purchase, provided the learner has completed less than 20% of the course content. No refunds are issued for the AI Smart Assistant tool after first use. For complete terms, please refer to our Refund Policy. No refunds are issued for voluntary account termination by the user.
8. Termination & Suspension
We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, are found cheating, fail to make payments, or attempt to disrupt the platform’s functionality. Upon termination, your right to use the Services ceases immediately. Provisions regarding IP, liability, and indemnity shall survive termination.
9. Limitation of Liability & Force Majeure
To the maximum extent permitted by law, RealEstateSmartly Academy and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits, data, or investment losses). Our total aggregate liability for any claim shall be limited to a maximum of INR 1,000.
We are not responsible for inaccuracies in third-party links, government records (RERA/EC), or builder-related disputes. Force Majeure: We shall not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet outages, or cyberattacks.
Government Office Disclaimer: Timelines for registration, mutation, or khata transfer depend on government office processing times and are beyond our control. Our “only one visit” commitment refers to our coordination — you may need additional visits if government officials require your physical presence for biometrics or original document verification.
10. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Karnataka, India. Class Action Waiver: Any disputes arising under these Terms shall be resolved individually, without resort to any form of class action. You agree to bring claims only in your individual capacity.

We will respond promptly under applicable copyright laws.
